Terms of sale

These general conditions of sale (hereinafter “General Conditions”) govern the methods and conditions of sale of the products marketed by the Seller through its website (hereinafter “Products”). All contracts for the sale of Products by the Seller to third parties (the “Customers”) are governed by these General Conditions, which form an integral and substantial part of every proposal, order and order confirmation for the purchase of the Products themselves. The conditions of sale applied to your order are those in force on the date of your order confirmation.

1 – Sales methods

After placing the items in the cart, proceed with sending the order, as soon as we receive it we will reply to you by email or telephone informing you of the availability of the items, delivery times, transport costs and the total amount (usually discounted) of the order including shipping costs and payment methods. At this point you can decide whether to confirm your order by replying to the email and indicating your preferred payment method, or cancel the order. Simple, safe and fast. Each order sent via the e-commerce site constitutes a contractual proposal by the Customer and, therefore, will be binding for the Seller only if confirmed for acceptance. The fulfillment of the order by the Seller is equivalent to confirmation and acceptance of the same. The tax documentation that certifies the purchase and activates the guarantee on the products is produced by the Seller in the form of a sales invoice at the time of shipment of the products and included in the shipment. It is therefore necessary for the customer to communicate his tax code or VAT number.

2 – Payment Methods

The payment methods accepted by the Seller are: Bank Transfer, PayPal, and cash on delivery (with some limitations). The payment method will be chosen by the Customer in his order confirmation email.

3 – Technical characteristics of the products

The technical and functional characteristics relating to the Products displayed on the website and communicated by telephone and/or e-mail are those communicated by the respective manufacturers. We cannot assume responsibility for the truthfulness and completeness of such information. Unless otherwise indicated, the manuals and Software relating to the Products are in English. The images of the products are indicative and not binding. Although we can provide information on the characteristics of the Products, the Customer is responsible for the choice of the Products ordered and for the correspondence and conformity of the specifications indicated by each manufacturer to their needs, we are not responsible for any anomalies due to incorrect use by the Customer.

4 – Product prices

All prices of the Products visible on the site are VAT INCLUDED (22% Italian). The prices of the Products from time to time published on the site cancel and replace the previous ones and are subject to the actual availability of the Products. We reserve the right to confirm or modify the prices of the Products published on its website or in information brochures and advertising material, at the time of the confirmation email of the Customer’s order (we remind you that in this case the customer is free not to confirm the order).

5 – Warranties and responsibilities

All items sold by us are covered by a regular manufacturer/importer warranty. To avail of this, it is necessary to keep the receipt/invoice attached to each shipping list. The Customer will only be entitled to the replacement of defective Products upon return of the same, excluding the Customer’s right to compensation for any damage, even further. The shipping costs necessary for the replacement of Products are at our expense. Technical assistance and warranty interventions on the Products are carried out, where applicable, by the individual Manufacturers, according to the terms and methods reported in the documentation attached to the Products themselves. In particular, the Seller does not provide any guarantee regarding the compatibility of the Products with other products or equipment used by the Customer, nor does it provide any guarantee regarding the suitability of the Products for the specific use intended by the Customer. Without prejudice to the cases of fraud or gross negligence of the seller, it is hereby agreed that, should the seller be found liable, in any capacity towards the Customer – including the case of total or partial non-fulfilment of the obligations undertaken by the Seller towards the Customer as a result of the execution of an order – the Seller’s liability may not exceed the price of the Products purchased by the Customer and for which the dispute has arisen.

6 – Shipping

All delivery costs for the Products are the Customer’s responsibility and are communicated in the order acceptance email. Deliveries are normally made via courier. The Seller has the right, at its sole discretion, to deliver the ordered Products via a different courier or via another means it deems appropriate. Unless otherwise indicated, all deliveries are made at street level.

The delivery times communicated in the order acceptance email must be considered non-binding for the Seller, who can subsequently confirm or modify them, depending on its actual needs. Any delays in deliveries of less than 30 (thirty) days do not entitle the Customer to refuse delivery of the Products, nor to claim compensation or indemnity of any kind.

7 – Right of withdrawal and returns

Pursuant to art. 5 of Legislative Decree 22 May 1999 n. 185, the Customer (if he/she qualifies as a “consumer” pursuant to art. 1 letter b) of Legislative Decree 22 May 1999 n. 185) has the right to withdraw from the contract and return the Products ordered, without any penalty and without specifying the reason, within 10 (ten) working days from receipt of the Products themselves. The right of withdrawal must be exercised by the Customer, under penalty of forfeiture, by sending a registered letter with return receipt to the Seller (references on the contact page of the site), within 10 (ten) working days from receipt of the Products. We recommend that you notify us by telephone before exercising this right.

The right of withdrawal cannot be exercised by the Customer if the Products purchased consist of sealed computer software, which have been opened by the Customer. All returns (which must be perfectly intact and accompanied by the original packaging) must be authorized by the Seller and subsequently shipped at the Customer’s expense to the address indicated on the contact page of the site. Once the Products have been received (and their integrity verified), the Seller will, as soon as possible, credit the Customer with the cost of the returned Products (as indicated on the invoice), withholding, where necessary, the amount of shipping costs which will remain definitively the responsibility of the Customer. In the event of replacement of the Product, the additional shipping is always to be understood as being the responsibility of the Customer.

8 – Competent forum

Without prejudice to the possible applicability of mandatory provisions of law for the protection of consumers (as defined in art. 1 letter b) of Legislative Decree 22 May 1999 n. 185), any dispute in any way connected to these General Conditions will be devolved to the exclusive jurisdiction of the competent Justice of the Peace pursuant to and for the purposes of articles 1341 and 1342 of the civil code. The Customer declares to have carefully read and understood and to specifically accept the following clauses of the General Conditions of Sale. The Operator: in all the points listed above.

Shipping your package

Packages are generally dispatched within 2 days of receipt of payment and are shipped via SDA with tracking.

Shipping costs include handling and packaging charges and postage. Handling costs are fixed, while shipping costs vary depending on the total weight of the shipment. We recommend that you group your items into one order. We cannot group two separate orders placed separately, so shipping costs will be charged for each order. Your package will be sent at your own risk, but special care is taken with fragile items.

The boxes are large enough and your items are well protected.

Payment Methods:

Credit card

In the case of purchase of goods with the payment method Credit Card, at the same time as the conclusion of the online transaction, the relevant banking institution will authorize only the commitment of the amount relating to the purchase made.

In the event of cancellation of the order, either by the Customer or in the event of non-acceptance of the same by the Seller, the Seller will simultaneously request the cancellation of the transaction and the release of the amount committed. The release times, for some types of cards, depend exclusively on the banking system and can reach their natural expiry (24th day from the date of authorization). Once the transaction has been cancelled, in no case can the Seller be held responsible for any damages, direct or indirect, caused by a delay in the failure to release the amount committed by the banking system.

The Seller reserves the right to charge the customer’s credit card in order to avoid the expiration of the transaction authorization which occurs on the 23rd day.

The Seller reserves the right to request additional information from the Customer (e.g. landline telephone number) or the sending of a copy of documents proving ownership of the Card used. In the absence of the requested documentation, the Seller reserves the right not to accept the order.

At no time during the purchase procedure will the Seller be able to know the information relating to the buyer’s credit card, transmitted via a protected connection directly to the site of the banking institution that manages the transaction. No computer archive and the Seller will retain such data. In no case may the Seller therefore be held responsible for any fraudulent or improper use of credit cards by third parties, at the time of payment for products purchased on the Seller’s site.

Mark

In the case of purchase by Cash on Delivery, an additional charge will be applied to the total amount, clearly highlighted when choosing the payment method. Payment must be made exclusively in the manner indicated by the Seller during the order. The communication to the Customer of which courier will be responsible for the delivery will be made with the methods indicated on the site. Nothing more than what is indicated at the time of the order will be owed by the Customer.

Advance Bank Transfer

The Advance Bank Transfer payment method cannot be used on all items in the catalog. Any limitations are clearly highlighted in the shopping cart. In the case of payment by Advance Bank Transfer, in order to reserve the goods with the availability displayed at the time of ordering, it will be necessary to provide proof of the transfer to be sent to Angel Distribuzione (via email) no later than 3 working days from the date of acceptance of the order. The shipment of the ordered goods will only take place upon actual crediting of the amount due to the Seller’s current account, which must occur within 7 working days from the date of acceptance of the order. After these deadlines, the order will be automatically considered cancelled. The reason for the bank transfer must include:

• • the order reference number;
• • the date the order was placed;
• • name and surname of the person placing the order;

Purchases via PayPal

In the case of purchase of goods with PayPal payment method, at the same time as the conclusion of the online transaction, PayPal will immediately charge the amount relating to the purchase made. In the event of cancellation of the order, either by the Customer or in the case of non-acceptance of the same by the Seller at the same time as the cancellation, the amount relating to the cancelled goods will be credited back to the customer’s PayPal account. The times for crediting back to the payment instrument chosen within the PayPal account depend exclusively on PayPal and the banking system. Once the amount has been credited back to the PayPal account, under no circumstances can the Seller be held liable for any damages, direct or indirect, caused by delays in the actual crediting dependent on PayPal or the banking system.

The Seller reserves the right to request additional information from the Customer (e.g. landline telephone number) to determine the actual ownership of the PayPal account. In the absence of the requested documentation, the Seller reserves the right not to accept the order.

At no time during the purchase process is the Seller able to know the information relating to the buyer’s credit card or the financial information of the PayPal account. In no case can the Seller therefore be held responsible for any fraudulent or improper use of credit cards by third parties, at the time of payment for products purchased on this site.
